Healey Commerce is committed to protecting your privacy in accordance with the Privacy Act 1988 (Cth) and the 13 Australian Privacy Principles (APPs). This policy explains how we collect, use, store, and disclose your personal information.

1.  Who We Are

Healey Commerce is an Australian performance marketing and eCommerce agency. We operate at healeycommerce.com.au and provide Meta advertising management, website design and development, and related digital marketing services to Australian businesses.

In this Privacy Policy, ‘we’, ‘us’, and ‘our’ refers to Healey Commerce. ‘You’ refers to any individual whose personal information we collect or hold.

2.  What Personal Information We Collect

We may collect the following types of personal information:

Information you provide directly:

•  Full name

•  Email address

•  Phone number

•  Business name and website URL

•  Monthly advertising spend and business details

•  Any other information provided via our enquiry or application forms

Information collected automatically:

•  IP address and browser type

•  Pages visited and time spent on our website

•  Referring URLs and device information

•  Cookie and tracking data (see Section 8)

Information from third parties:

•  Advertising performance data from Meta Business Manager (where you grant us access)

•  eCommerce platform data from Shopify or similar tools (where you grant us access)

•  Analytics data from Google Analytics or similar tools

We only collect personal information that is reasonably necessary for our business functions. We do not collect sensitive information without your explicit consent.

3.  How We Collect Personal Information

3.1  Directly from you — via our website forms, email, phone calls, onboarding questionnaires, and service agreements.

3.2  Automatically — via cookies and analytics tools when you visit our website.

3.3  From third parties — via advertising and analytics platforms you grant us access to for delivering our services.

4.  Why We Collect and Use Your Information

We collect and use personal information for the following purposes:

(a)  To respond to your enquiry or application and determine suitability for our services.

(b)  To provide and manage the services you have engaged us to deliver.

(c)  To invoice you and manage our business relationship.

(d)  To communicate about your account, campaign performance, and relevant updates.

(e)  To improve our website, services, and client experience.

(f)  To comply with our legal obligations under Australian law.

(g)  To send marketing communications where you have consented or where permitted by law (you may opt out at any time).

5.  Disclosure of Personal Information

We may disclose your personal information to:

(a)  Service providers who assist in operating our business (email, project management, accounting, analytics) — under confidentiality obligations.

(b)  Meta Platforms, Inc. (Facebook/Instagram) and other advertising platforms as part of delivering our services.

(c)  Our accountant, legal adviser, or other professional advisers, under confidentiality obligations.

(d)  Law enforcement, courts, or regulators where required or permitted by law.

We do not sell, rent, or trade your personal information to third parties for their own marketing.

Overseas disclosure:

Some service providers are located overseas, including in the United States (Meta Platforms, Inc. and Google LLC). We take reasonable steps to ensure these providers handle your information consistently with the Australian Privacy Principles. By using our services, you consent to potential overseas disclosure to these providers.

6.  How We Store and Protect Your Information

6.1  We store personal information electronically using cloud-based tools including Google Workspace, protected by passwords and access controls.

6.2  We take reasonable steps to protect your information from misuse, loss, unauthorised access, modification, and disclosure.

6.3  We retain personal information for as long as necessary — typically no longer than 7 years after the end of our business relationship (for tax and legal compliance).

6.4  When no longer required, we take reasonable steps to destroy or de-identify personal information securely.

7.  Your Rights — Access, Correction & Complaints

Access and correction:

You have the right to request access to personal information we hold about you, and to request correction if it is inaccurate, incomplete, or out of date. Contact us at contact@healeycommerce.com.au. We will respond within 30 days. We may charge a reasonable fee for access and may refuse in limited circumstances permitted by the Privacy Act 1988.

Complaints:

If you believe we have mishandled your personal information or breached the Australian Privacy Principles, contact us at contact@healeycommerce.com.au. We will investigate and respond within 30 days. If you are not satisfied, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at http://www.oaic.gov.au or on 1300 363 992.

8.  Cookies & Website Tracking

8.1  Our website may use cookies to improve browsing experience and analyse website traffic.

8.2  We may use Google Analytics to collect aggregated, anonymised data. Google’s privacy policy is at policies.google.com/privacy.

8.3  You can control or disable cookies through your browser settings. Disabling cookies may affect some website functionality.

8.4  We do not use cookies to collect personally identifiable information without your knowledge.

9.  Marketing Communications

If you have enquired about or engaged our services, we may send relevant marketing emails. You may opt out at any time by clicking ‘unsubscribe’ in any email or emailing contact@healeycommerce.com.au with ‘Unsubscribe’ in the subject. We will process opt-out requests within 5 business days. We will continue sending transactional communications (invoices, reports) regardless of marketing opt-out.

10.  Text Messages (SMS)

If you give us your mobile number and tick the box to get text updates, we will text you about your Ad Leak Score, your Snapshot, and any call you book with us. Every message comes from Healey Commerce. We only send marketing texts to people who have said yes. Booking confirmations and reminders for a call you have booked are service messages.

You can opt out at any time. Reply STOP to any text and we will stop messaging you. You can also email contact@healeycommerce.com.au and we will remove your number. We act on opt-outs promptly and within five working days at the latest. We keep a record of when and how you agreed, so we can show that you did.

11.  Matching Your Details with Meta for Advertising

We advertise on Facebook and Instagram. To do that, we may upload contact details we hold about people who have enquired with us or taken our quiz (for example an email address or phone number) to Meta. We send them in hashed form: scrambled by a one-way process before they leave our systems, so Meta receives a code rather than your plain details. Meta matches that code against its own users so that we can show our ads to similar people, and stop showing our ads to people who are already customers or who have asked us to stop. Meta handles that data under its own terms and privacy policy.

To opt out, email contact@healeycommerce.com.au and ask us to remove you from our advertising audiences. We will exclude you from future uploads. You can also control the ads you see in your own Meta account settings.

12.  Service Providers Who Handle Your Details

We use GoHighLevel (HighLevel Inc.) as our customer management and messaging platform. It stores the details you give us (name, email, mobile number, quiz answers, booking details) and sends the emails and texts described above on our behalf. It acts as our service provider: it handles your information to provide that service to us, not for its own marketing. Its servers may be outside Australia, so your information can be stored or processed overseas, including in the United States. We use other tools to run the business (for example Google Workspace and Google Meet, our website host, and Meta for advertising). We only share the information those providers need to do their job.

13.  Call Recording

Calls we hold with you (for example your live teardown on Google Meet) may be recorded so we can keep accurate notes of what we agreed. We tell you at the start of the call and on the booking page. You can say no at any time, before or during the call, and we will not record, or we will stop and delete the recording. Say so at the start of the call or email contact@healeycommerce.com.au. We keep recordings only as long as we need them for those notes, and we do not share them outside Healey Commerce except with the service providers above.

14.  Children’s Privacy

Our services and website are not directed to individuals under 18. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us and we will promptly delete it.

15.  Changes to This Privacy Policy

We may update this Privacy Policy from time to time. Updated versions will be posted on our website with the revised date. Active clients will receive email notice of material changes.
